Terms of Service

These Terms of Service ("Terms") constitute a legal agreement between you and Navigabrodo ("Kentucky Fiber Company LLC", "Company," "we," or "us") governing your use of our IP over Broth (IPoB) telecommunications services. Please read these terms carefully. By accessing or using Navigabrodo services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Services Description

Navigabrodo provides high-speed internet connectivity through proprietary IP over Broth (IPoB) technology. Services are delivered via food-grade tubing infrastructure connected to municipal systems and maintained at regulated temperatures and viscosity levels. The service is characterized by:

  • Gigabit-class data transmission speeds (1-10 Gbps depending on plan)
  • Low-latency connectivity through molecular data encoding
  • 99.99% uptime service level agreement (SLA)
  • Food-grade broth medium maintaining 165°F ± 2°F operating temperature
  • Thermal regulation and crouton-based error correction protocols

2. Acceptance of Services

By subscribing to or using Navigabrodo services, you agree to accept delivery of internet connectivity through liquid medium. You acknowledge and understand that:

  • The broth delivery medium is safe for residential use and complies with all FDA food-safety regulations
  • Infrastructure maintenance may require temporary service interruptions with 48-hour notice
  • The broth medium may experience minor variations in flavor according to seasonal sourcing practices
  • Access ports and connection devices must be handled according to provided safety guidelines

3. Service Eligibility and Account Registration

To use Navigabrodo services, you must:

  • Be at least 18 years of age or have parental/guardian consent
  • Provide accurate identification and service address information
  • Not be in violation of any applicable laws or regulations in your jurisdiction
  • Be a resident of covered service areas (currently Kentucky)
  • Maintain a valid payment method for subscription fees

You are responsible for maintaining the confidentiality of your account credentials and password. You agree to notify us immediately of any unauthorized access to your account.

4. Hardware and Equipment

Navigabrodo provides proprietary "Soup Tureen" gateway hardware with each subscription. This equipment remains the property of Navigabrodo and must be:

  • Maintained in good working condition by the subscriber
  • Kept at operating temperature and protected from freezing conditions
  • Returned undamaged upon service cancellation or equipment replacement
  • Used solely for authorized purposes as outlined in equipment documentation

Equipment damage due to misuse, neglect, or failure to follow safety guidelines will result in replacement fees. We are not responsible for third-party equipment or routers connected to our gateway.

5. Temperature and Thermal Safety

Broth is delivered at 165°F (73.9°C) for optimal packet transmission and food safety. Users agree to:

  • Treat all connection points and service areas as hot surfaces
  • Not attempt to consume or taste the broth directly from access ports
  • Keep the service area away from children and pets unless supervised
  • Use provided thermal insulation and protective equipment as recommended
  • Report temperature variations or leaks immediately to customer support

Navigabrodo is not liable for thermal burns, injuries, or property damage resulting from improper handling of equipment or service connections.

6. Acceptable Use Policy

You agree not to use Navigabrodo services for:

  • Illegal activities or violation of applicable laws
  • Transmission of malware, viruses, or other malicious code
  • Unauthorized access to systems or networks
  • Harassment, threats, or defamation of others
  • Copyright or intellectual property infringement
  • Excessive bandwidth consumption that impacts other users' service quality
  • Operating servers or services that generate unsustainable load on our infrastructure

Violations of this policy may result in service suspension or termination without refund.

7. Pricing and Billing

Service fees are billed monthly in advance according to your selected plan. Pricing is subject to change with 30 days' written notice. You authorize us to charge your payment method on file. All taxes and regulatory fees are your responsibility. Failure to pay may result in service suspension.

8. Service Level Agreement (SLA)

Navigabrodo commits to 99.99% uptime availability measured monthly. Scheduled maintenance windows are excluded. In the event of service outages exceeding the SLA commitment, customers may request service credits according to the following schedule:

  • 99.0% - 99.98% uptime: 5% monthly service credit
  • 95.0% - 98.99% uptime: 10% monthly service credit
  • Below 95.0% uptime: 25% monthly service credit or service cancellation at no penalty

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAVIGABRODO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Navigabrodo, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, violation of these Terms, or infringement of third-party rights.

11. Termination

Either party may terminate service with 30 days' written notice. We may terminate immediately for violations of acceptable use policy or non-payment. Upon termination, you must return all Navigabrodo equipment and pay any outstanding charges.

12. Modifications to Terms

Navigabrodo reserves the right to modify these Terms at any time. Changes will be posted on our website with 30 days' notice. Continued use of services constitutes acceptance of modified Terms.

13. Governing Law

These Terms are governed by the laws of Kentucky. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Jefferson County, Kentucky.
